ADU Rental Agreement
This Month-to-Month Rental Agreement is made by and between Bon Vivant Properties LLC (Homeowner) and Fatima Zahra Layla (Guest) as of the date last set forth on the signature page of this Agreement. This agreement grants the Guest a revocable license to occupy the property, which may be terminated at the Homeowner’s discretion, and does not create a lease or any legal interest in the property. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
1. Property
The rental property is located at: 33 Don Gabriel Way, Unit A, Orinda, CA 94563
2. Maximum Occupancy
The maximum number of guests is limited to 2 persons. No additional overnight guests are allowed.
3. Term of Rental - Month to Month
The rental term begins at 3:00 PM PT on September 1, 2025 (“Start Date”) and continues on a month-to-month basis. The initial term ends at 11:00 AM PT on May 31, 2026 (“End Date”), unless extended.
The Guest may extend the term until August 31, 2026 by providing written notice to the Homeowner on or before March 15, 2026.
The Guest may terminate this agreement at any time by providing the Homeowner with at least 30 days’ written notice.
The Homeowner may terminate this agreement with 30 days’ written notice only if the Guest breaches the terms of this agreement or violates the Rental Rules. In such cases, the Homeowner shall provide written notice specifying the nature of the violation and the effective date of termination, which shall be no less than 30 days from the notice date.
If no extension is requested by March 15, 2026, the tenancy will automatically terminate on May 31, 2026 without further notice required from either party.
4. Rental Rules
Guest agrees to abide by the Rental Rules at all times while at the property and shall ensure all members of the rental party and any visitors comply with these rules:
- Guests must conduct a property inspection upon check-in and report any problems to the Homeowner immediately. Photos and videos of any issues are encouraged.
- Accidents happen—please report any damages to the property or its contents as soon as discovered.
- The Homeowner reserves the right to terminate this Agreement with 30 days’ notice in the event of rule violations. Severe violations may result in immediate termination and removal in accordance with applicable laws.
- Guests must be 25 years of age or older to rent the property.
- No smoking is allowed anywhere on the property. Violation of this rule will result in additional cleaning fees and termination of this Rental Agreement.
- Check-in and check-out times must be adhered to unless prior written modifications are obtained. Failure to vacate the property by the designated check-out time will incur a late fee of $250.
- No events, parties, or large gatherings are allowed on the property.
- Local ordinances prohibit loud noise or music between 10:00 PM and 7:00 AM PT.
- No pets are allowed unless explicitly approved by the Homeowner in writing.
- The property is not childproof. Guests are solely responsible for ensuring the safety of any children in their party.
- Guests must follow any additional rules outlined in the House Guide on the Bon Vivant Website, dated version of "Jan 12, 2025".
- Guests are not permitted to enter the backyard of the Main House without prior written approval from the Homeowner.
- Guest acknowledges that the Homeowner has two small dogs with access to the Main House backyard from 8:00 AM to 10:00 PM PT, which may create noise from barking.
5. Access
The Guest shall allow the Homeowner access to the property for purposes of repair, inspection, or emergency. The Homeowner will provide at least 8 hours notice before entry unless it is an emergency.
6. Rental Rates and Fees
Rent is $2875 per month which includes all utilities.
A $1,000 deposit is required at the time of booking to reserve the property. The remaining balance for the first month's rent must be paid at least 14 days prior to check-in. Rent for subsequent months is due by 8:00 PM on the last day of the prior month.
In addition to the nightly rate, the following fees apply and will be included in the final invoice:
Cleaning Fee: $90 per stay (waived)- Credit Card Transaction Fee: 2.9%
- Unauthorized Late Check-out Fee: $250
- Additional Cleaning Fees: Variable (if property requires extra cleaning due to smoking or excessive mess).
7. Cancellation Policy
Full Refund: Cancellations made at least 30 days before check-in will receive a full refund.
No Refund: Cancellations made fewer than 30 days before check-in are non-refundable.
8. Liability and Insurance
The Homeowner is not responsible for any injuries, loss, or damage to personal property incurred during the Guest’s stay. Guests agree to use the property at their own risk.
9. Payment
Acceptable payment methods are Credit Card, Zelle, Venmo, or Cash.
10. Furnishing
Homeowner agrees to replace the Living Room TV and TV Stand with a Computer Desk and Chair at no additional cost to the Guest.
By signing below, I consent to the use of electronic records and signatures in connection with this Agreement. I authorize Bon Vivant Properties LLC to charge my credit card for the initial deposit, monthly rent payments, and any additional fees incurred as specified in this Agreement. I acknowledge that I have read and understand the cancellation policy, and I agree to comply with all terms, conditions, and rental rules outlined herein.
