Vacation Rental Agreement

This License-to-Occupy Agreement is made by and between Bon Vivant Properties LLC (Homeowner) and Signee (Guest) as of the date last set forth on the signature page of this Agreement. This license is revocable at the will of the licensor (Homeowner), and creates no legal interest in the property. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

1. Property

The rental property is located at: 33 Don Gabriel Way, Unit A, Orinda, CA 94563

2. Maximum Occupancy

The maximum number of guests is limited to 2 persons. No additional overnight guests are allowed. 

3. Term of Rental

The rental period begins at 3:00 PM PT on the "Check-in Date" and ends at 11:00 AM PT on the "Check-out Date."

Failure to vacate the property by the designated check-out time without prior approval will incur a late fee of $250.

4. Minimum Stay

This property requires a 2-night minimum stay. Longer minimum stays may be required during holiday periods. If a rental is taken for less than 1 day, the guest will be charged the nightly rate.

5. Rental Rules

Guest agrees to abide by the Rental Rules at all times while at the property and shall ensure all members of the rental party and any visitors comply with these rules:

  1. Guests must conduct a property inspection upon check-in and report any problems to the Homeowner immediately. Photos and videos of any issues are encouraged.
  2. Accidents happen—please report any damages to the property or its contents as soon as discovered.
  3. The Homeowner reserves the right to terminate this Agreement and remove the Guest and their party from the property for violation of Rental Rules, without refund.
  4. Guests must be 25 years of age or older to rent the property.
  5. No smoking is allowed anywhere on the property. Violation of this rule will result in additional cleaning fees.
  6. Check-in and check-out times must be adhered to unless prior written approval is obtained or an Early Check-in/Check-out upgrade is purchased in advance.
  7. No events, parties, or large gatherings are allowed on the property.
  8. Local ordinances prohibit loud noise or music between 10:00 PM and 7:00 AM PT.
  9. No pets are allowed unless explicitly approved by the Homeowner in writing.
  10. The property is not childproof. Guests are solely responsible for ensuring the safety of any children in their party.
  11. Guests must follow any additional rules outlined in the House Guide on the Bon Vivant website.
  12. Guests are not permitted to enter the backyard of the Main House without prior approval from the Homeowner.
  13. Guest acknowledges that the Homeowner has two small dogs with access to the Main House backyard from 8:00 AM to 10:00 PM PT, which may create noise from barking.

6. Access

The Guest shall allow the Homeowner access to the property for purposes of repair, inspection, or emergency. The Homeowner will provide at least 4 hours' notice before entry unless it is an emergency.

7. Rental Rates and Fees

  • Stays of 30 days or less: Full payment is required at the time of booking.
  • Stays longer than 30 days: A $1,000 deposit is required at the time of booking to reserve the property. The remaining balance for the first month's rent must be paid at least 7 days prior to check-in. Rent for subsequent months is due by 11:59 PM on the last day of the prior month.

In addition to the nightly rate, the following fees apply and will be included in the final invoice:

  • Cleaning Fee: $90 per stay
  • City of Orinda Transient Occupancy Tax: 8.5% (For stays <30 days)
  • Credit Card Transaction Fee: 2.9%
  • Unauthorized Late Check-out Fee: $250
  • Additional Cleaning Fees: Variable (if property requires extra cleaning due to smoking or excessive mess).

8. Cancellation Policy

Full Refund: Cancellations made at least 14 days before check-in will receive a full refund.Bookings Made Fewer Than 14 Days Before Check-in: A full refund is available if canceled within 48 hours of booking.Partial Refund: Cancellations made between 7 and 13 days before check-in will receive a 50% refund.No Refund: Cancellations made fewer than 7 days before check-in are non-refundable.


9. Liability and Insurance

The Homeowner is not responsible for any injuries, loss, or damage to personal property incurred during the Guest’s stay. Guests agree to use the property at their own risk.

Guests are encouraged to purchase travel insurance to cover unforeseen circumstances, accidents, or other issues that may prevent fulfilling the terms of this Agreement. VacationRentalInsurance.com is one option, but similar coverage may be available from other providers.

10. Payment

Acceptable payment methods are Credit Card, Zelle, Venmo, or Cash.

By signing below, I hereby give permission to charge my credit card for the total amount of my reservation and any additional fees incurred as stated in this Agreement. I understand the cancellation policy and have been advised of my rights to purchase travel insurance.

By checking here, you acknowledge you have read and understand the above terms, and are consenting to the use of your electronic signature in lieu of an original signature on paper. You have the right to request that you sign a paper copy instead. By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
